Monell noted that, in the case of acidity, “Nexium is not a drug intended to treat that condition. It is a prescription medicine and, as such, has not been shown to have adverse effects on patients in the clinical setting.”

The lawsuit alleges that AstraZeneca knew or should have known about the risks associated with Nexium before the drug was approved for sale in the United States, but failed to properly disclose them and marketed its medication for those who suffer from heart failure and diabetes, or people who are overweight.
